Yes, a Golden Visa works like a tourist visa for the rest of the countries they belong to in the Schengen area.

A Schengen visa is a short stay visa allowing its holder to circulate in the Schengen area. The Schengen area covers 26 countries (“Schengen States”) without border controls between them. These countries are: Austria, Belgium, the Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Iceland, Italy, Latvia, Liechtenstein, Lithuania, Luxembourg, Malta, the Netherlands, Norway, Poland, Portugal, Slovakia, Slovenia, Spain, Sweden and Switzerland.

A Schengen visa is an authorisation issued by a Schengen State with a view to:

  • an intended stay in the territory of the Schengen States of a duration of no more than 90 days in any 180 days period (“short stay visa”),

a transit through the international transit areas of airports of the Schengen States (“airport transit visa”).

Yes, if you live in Spain with the Golden Visa, after five years of effective residence you can become long-term resident and obtain a residence permit valid for periods of five years.

The Golden Visa differs radically from traditional Spanish residence permits in various aspects:

a) The renewal of the Golden Visa does not require a minimum stay in Spain.

Once the long-term residence is obtained, it is no longer necessary to maintain the amount of the investment so you can sell the property or you can rent it out.

General documents:
– Identity document or passport.
– Public or private health insurance taken out with a company operating in Spain.
– Background check.
– Proof of sufficient funds to support the applicant and members of his/her family
during residence in Spain.

The government immigration department requests a criminal record certificate from the country of origin, for the initial presentation of the GOLDEN VISA, and if they have remained in Spain for less than 6 months, they must also be provided for renewal.
If they have a criminal record, the investment residency Visa will NOT be approved.

Proof of sufficent funds must be shown in a Spanish bank account or in a current account in the country of origin.

We always  recommend it to be kept in a Spanish  current account with at least 15,000 Euros.

The total amount will depend on how many family or business members apply for residence together with the holder.

Supporting documentation. Documents providing proof of the investment:

REAL ESTATE ASSET (500,000 Euros):
A) If the purchase has been formalized:

– certificate of registration of the property and purchase deeds of the real estate. from the Property Registry Office. The certification will incorporate an electronic verification code for online consultation, said certificate or certification, to be admitted, will have to be issued, at most, 90 days before the visa application.

– If at the time of the visa application, the acquisition of the real estate is in the process of being registered in the Property Registry, the presentation of the aforementioned certification in which the entry of the acquisition document is valid will suffice. , accompanied by supporting documentation of the payment of the corresponding taxes.

– The applicant must prove that they have an investment in real estate of 500,000 euros free of all charges or encumbrances. The part of the investment that exceeds the required amount may be subject to a charge or encumbrance.

B) If the purchase has not yet been formalized:

– Pre-contract of guarantee together with a certificate from a financial entity established in Spain in which it is verified that the applicant has an unavailable bank deposit with the amount necessary for the acquisition, complying with the agreed contract, of the property or properties indicated therein, including charges and taxes.

WHEN BUYING Shares, bank deposits (1 million), or Public debt (2 million):

• Unlisted shares and equity: statement of investment filed with the Investments
Register of the Ministry of Economy and Competitiveness (Registro de
Inversiones).

• Listed shares: document from a financial broker registered with the National
Securities Market Commission (CMNV) or the Bank of Spain.

• Public debt: certificate from the financial institution or the Bank of Spain
indicating that the applicant has been the sole owner of the investment for a
period of not less than five years.

• Bank deposits: certificate from the financial institution indicating that the
applicant is the sole owner of the bank deposit.

WHEN OPTING FOR BUSINESS PROJECT in Spain considered being of general interest:

• Business project: before applying for a visa or permit, a favorable report is
required on the business and entrepreneurial activity intended to be carried out
in Spain

Where do I request the general interest report?


For Golden visas, the report on the entrepreneurial activity of interest should be requested from the Spanish Economic and Trade Office in the same area where the visa is requested.

For residence permits, the general interest report should be requested before applying
for a residence permit at the Directorate-General for Trade and Investment.


What should I bring to request the General interest report for Golden Visa?


The business plan of the project, specifically: the professional profile of the investor,
the type of business activity, the number of jobs that will be created, the features and
qualifications required for each, where the project will be set up (geographical area),
how much the investment will be and the origin of the funds.


What is a project in the general interest for Golden Visa?

Article 206 of the Regulations of Organic Law 4/2000, on the rights and freedoms of foreigners in Spain and their social integration, approved by Royal Decree 557/2011, of 20 April 2011, sets forth that foreigners having a relation with Spain for economic, professional or social interests shall be provided with a personal, unique and exclusive sequential number, for identification purposes. 

Consequently, foreigners having a relation with Spain for economic, professional or social interests may personally apply for an N.I.E. at the Directorate-General of the Police, either directly or through Spain’s Consular Posts abroad.
 
Applications must be submitted at the Consular Post of the district in which the foreigner resides, either personally or through a duly accredited representative, and the application must be accompanied by a copy of the biographical page of the passport containing the holder’s information (EU citizens can provide a copy of their identity card), and by proof of the economic, professional or social interests justifying the application.

Supporting documentation:

Residency Requirement for Citizenship: To apply for Spanish citizenship, the standard requirement, as mentioned before, is ten years of legal residency. The years lived under the Golden Visa count towards this residency requirement of course.

 

Citizenship Application Process: After fulfilling the ten-year residency requirement, the individual can apply for Spanish citizenship. This involves passing language and cultural knowledge tests, proving integration into Spanish society, and maintaining a clean criminal record.

 

Obtaining Citizenship and Spanish Passport: Once the citizenship application is approved, the individual can take an oath of loyalty to Spain and apply for a Spanish passport, completing the journey from Golden Visa to Spanish citizenship.

 

  1. Legal Residency in Spain:

    • You must have lived legally in Spain for a continuous period. Typically, this period is 10 years, but it can be less in certain cases (read next FAQ). The time lived under the Golden Visa counts towards this period.
  2. Integration into Spanish Society:

    • You must demonstrate integration into Spanish society, which might include language proficiency and understanding of Spanish culture and societal norms.
  3. Application for Citizenship:

    • Once you meet the residency requirement, you can apply for citizenship.
  4. Required Documentation:

    • You will need to provide various documents, such as your residency permit, passport, proof of legal residence, employment records, and possibly tax returns.
  5. Language and Cultural Knowledge Test:

    • Applicants are generally required to pass a language proficiency test (DELE A2 level or higher) and a cultural knowledge test (CCSE) about Spain.
  6. Criminal Record Check:

    • A clean criminal record, both in Spain and in your home country, is typically required.
  7. Oath of Loyalty:

    • After approval, you must swear allegiance to the King and promise to obey Spanish laws and constitution.
  8. Issuance of Citizenship:

    • Once all the steps are completed and the application is approved, you will be granted Spanish citizenship.
  9. Obtaining a Spanish Passport:

    • After receiving citizenship, you can apply for a Spanish passport at the local police station or relevant authority.
  10. Renunciation of Previous Citizenship:

  • Depending on your country of origin, you might have to renounce your previous citizenship, as Spain does not allow dual citizenship as the norm.

Obtaining Spanish citizenship typically requires a continuous legal residency of 10 years for most non-EU citizens. However, there are certain circumstances under which the residency requirement may be reduced. These include:

 

  1. Marriage to a Spanish Citizen: If the non-EU citizen is married to a Spanish national, the required residency period before applying for citizenship can be reduced to just 1 year of legal residency before applying for citizenship. The marriage must be valid and registered, and the couple should ideally be living together in Spain.

 

  1. Refugee Status: Refugees are often allowed to apply for citizenship after a reduced residency period (shortened to 5 years). This is in recognition of the special circumstances and vulnerabilities faced by refugees.

 

  1. Exceptional Circumstances: In some cases, the Spanish government may grant citizenship under exceptional circumstances, which might reduce the residency requirement. This is evaluated on a case-by-case basis. Examples might include individuals who have made significant contributions to Spanish society or culture, or those who have special circumstances that warrant a faster path to citizenship. The duration of the reduced residency period in such cases can vary greatly depending on the specifics of each situation.
